A284. The first paragraph of 98.6 states, "All terms used in this part shall have the same meaning given in the Clean Air Act and this section." "Owner" and "operator" are specifically defined in 98.6 therefore you must use the definition of "owner" and "operator" as appears in 98.6. The final rule does not define the term "person." However, Section 7602(e) of the Clean Air Act states that the term "person" includes an individual, corporation, partnership, association, State, municipality, political subdivision of a State, and any agency, department, or instrumentality of the United States and any officer, agent, or employee thereof. This definition of "person" applies to Part 98.
