EPA Issues NODA on Global Warming Potentials
EPA is making available for public comment estimated global warming potentials (GWPs), and the analysis supporting them, for several fluorinated GHGs and fluorinated HTFs. The Notice of Data Availability (NODA) provides a thirty (30) day comment period following publication in the Federal Register. The comments submitted in response to this notice will inform future amendments to Table A-1 to Part 98, adding the GWPs of some or all of the fluorinated GHGs and fluorinated HTFs listed in the notice. Administrator signs direct final action to revise Subpart W BAMM
On February 7, 2013, the EPA Administrator signed a direct final action revising the deadline by which owners or operators of facilities subject to the Petroleum and Natural Gas Systems Source Category of the Greenhouse Gas Reporting Rule (40 CFR Part 98) must submit requests for use of best available monitoring methods (BAMM) to the Administrator. More specifically, this action amends the September 30 deadline for submitting BAMM requests to June 30 of each year prior to the reporting year for which use of BAMM is sought. This revision does not change any other requirements for owners or operators that are outlined in the BAMM rule provisions. More information. |

EPA releases 2011 Greenhouse Gas Reporting Program (GHGRP) data
The second year of GHGRP data includes information from facilities in 41 source categories. The 2011 data set contains information collected from approximately 1,000 facilities in 12 new source categories, including petroleum and gas natural systems, industrial landfills, coal mines and others. Highlights include: power plants remain the largest stationary source of GHG emissions, with 2,221 million metric tons carbon dioxide equivalent (mmtCO2e), roughly one-third of total U.S. emissions. Petroleum and natural gas systems were the second largest sector, with emissions of 225 mmtCO2e. Refineries were the third-largest emitting source, with 182 mmtCO2e. EPA now has two years of GHG data for the original 29 source categories. Overall emissions reported from these 29 sources were 3 percent lower in 2011 than in 2010, drive by a decrease in emissions from power plants. Technical Corrections Finalized
On August 3, 2012, EPA Administrator Lisa P. Jackson signed Technical Corrections to address concerns raised by reporters and to correct errors. The final amendment provides greater clarity and flexibility to facilities subject to subparts A (General Provisions), I (Electronics Manufacturing), L (Fluorinated Gas Producers), W (Petroleum and Natural Gas Systems), and TT (Industrial Waste Landfills). Confidentiality determinations and amendments finalized
On August 2, 2012, EPA Administrator Lisa P. Jackson signed confidentiality determinations for most data elements to be reported under nine subparts of the Greenhouse Gas Reporting Program [I (Electronics Manufacturing), W (Petroleum and Natural Gas Systems), DD (Electrical Transmission and Distribution Equipment Use), II (Industrial Wastewater Treatment), QQ (Importers and Exporters of Fluorinated Greenhouse Gases Contained in Pre-charged Equipment or Closed-cell Foams), RR (Geologic Sequestration of Carbon Dioxide), SS (Electrical Equipment Manufacture or Refurbishment), TT (Industrial Waste Landfills), and UU (Injection of Carbon Dioxide)], and finalizes amendments to subpart I (Electronics Manufacturing) to remove the requirement for a facility to recalculate the previous reporting years' emissions and resubmit them to EPA where the use of best available monitoring methods (BAMM) is allowed. New Technical Corrections Proposed
U.S. EPA is proposing to make revisions and clarifications to the Greenhouse Gas Reporting Rule to facilitate implementation of the Greenhouse Gas Reporting Program (GHGRP). EPA is amending and clarifying certain terms and provisions within Subpart A (General Provisions); Subpart L (Fluorinated Gas Producers); Subpart W (Petroleum and Natural Gas Systems); and Subpart TT (Industrial Waste Landfills) to clarify rule provisions, modify specific provisions to address concerns raised by reporters, and correct errors. The proposed amendments are not anticipated to place additional requirements on reporters and do not significantly change the monitoring and calculation methodologies. Corrections and clarifications made in this action will be helpful to owners and operators of facilities subject to the upcoming September 28, 2012 reporting deadline. More information. |

Updated GHGRP data released
On April 16, 2012, EPA is releasing updated greenhouse gas data collected through the Greenhouse Gas Reporting Program (GHGRP) for reporting year 2010. These files are available for download here: http://www.epa.gov/ghgreporting/ghgdata/2010data.html. For the first time, EPA is releasing data reported by suppliers of petroleum products as reported under Subpart MM for 2010. The total GHG quantity associated with products supplied by each refinery is available in the suppliers portion of the publication tool, and also available for download. EPA has also made available for download the total GHG quantity reported by importers and exporters of petroleum products as reported to the GHGRP for 2010. Facilities continue to re-submit their 2010 GHG annual reports; therefore, EPA has released updated versions of all files available for download and updated each facility's 2010 report in the GHGRP publication tool. All data is now consistent with the latest report received from facilities by April 6, 2012. EPA has updated the data in the excel file that summarizes 2010 data to now include emissions reported by facilities under Subpart U — Miscellaneous Use of Carbonates. This file also now indicates which facilities report CO2 emissions that include CO2 collected on-site and used to manufacture other products or transferred off-site or injected. EPA has updated the publication tool to reflect the county in which each facility is located in. This information was incomplete in the last release. |

EPA Launches GHGRP Interactive Tutorial
On April 12, 2012, EPA released an interactive training presentation covering the general requirements of the Greenhouse Gas Reporting Program (GHGRP). Intended for all audiences, the online training is enhanced with voiceover narration, and comprises five informational modules:

EPA Releases Updated 2010 GHGRP Data
On February 22, 2012, EPA updated the Greenhouse Gas Reporting Program (GHGRP) data publication tool to reflect revised data submitted by facilities in the December 17th – February 10th time frame . EPA also made other improvements to the data publication tool, including adding features to perform new queries of the data. In addition, two new GHGRP data sets are being released and may be found on the GHGRP data downloads page. The first data set includes non confidential data elements provided by reporters and is available in XML format. The types of data elements provided in this file include methods used by the facilities to estimate their emissions, unit level data (if this data is non-confidential) and other facility-specific data. The second file contains the name and location of each facility's highest-level United States parent company or companies, as reported to EPA. A description of the changes made to the publication tool since its original launch in January is available on the Release Notes page. |

Subpart W CBI determinations and deadline deferral proposed
On February 16, 2012, EPA issued a proposal to determine which data elements reported under subpart W of Part 98 would or would not be entitled to confidential treatment under the Clean Air Act (CAA). These data elements will be reported to EPA for the first time in September 2012. In addition, this action proposes to defer the deadline for reporting some recently added subpart W data reporting elements that are "inputs to emission equations" until 2015. More information |

Administrator Signs Two Actions Related to Subpart I, Electronics Manufacturing
On February 10, 2012, EPA issued a proposal to determine which data elements reported under subpart I of Part 98 would or would not be entitled to confidential treatment under the Clean Air Act (CAA). These data elements will be reported to EPA for the first time in September 2012. In addition, this action proposes to amend subpart I to remove the requirement that facilities that use best available monitoring methods (BAMM) recalculate the previous reporting years' emissions and resubmit them to EPA. On February 10, 2012, the U.S. Environmental Protection Agency (EPA) also issued a final action to amend the Electronics Manufacturing source category of the Greenhouse Gas Reporting Rule, part 98. More specifically, EPA finalized amendments to the definition of fluorinated heat transfer fluids (HTFs) and to the provisions to estimate and report emissions from HTFs. EPA is finalizing these changes to reflect the Agency's intent to cover all fluorocarbons (except for ozone depleting substances regulated under EPA's Stratospheric Protection Regulations at 40 CFR Part 82) that can enter the atmosphere under the conditions in which HTFs are used in the electronics manufacturing industry. e-GGRT Maintenance Outage Planned for 2/11/2012 through the week of 2/20/2012
e-GGRT will be unavailable for at least a 10 day period to allow for system upgrades needed to support Reporting Year 2011. Starting on Saturday Feb. 11, 2012 until the week of Feb. 20, 2012 e-GGRT will be unavailable. Once these upgrades are complete e-GGRT will be available for RY2011 reporting. |

2010 Greenhouse Gas Emissions Data from Large Facilities Now Available
For the first time, comprehensive greenhouse gas (GHG) data reported directly from large facilities and suppliers across the country are now easily accessible to the public through EPA's GHG Reporting Program. The 2010 GHG data released on January 11, 2012 includes public information from facilities in nine industry groups that directly emit large quantities of GHGs, as well as suppliers of certain fossil fuels and high global warming gases. On December 22, 2011, EPA issued a proposal to determine whether the Greenhouse Gas Reporting Program data elements in subparts L (Fluorinated Gas Production), DD (Electrical Transmission and Distribution Equipment Use), QQ (Importers and Exporters of Fluorinated Greenhouse Gases Contained in Pre-charged Equipment or Closed-cell Foams), RR (Geologic Sequestration of Carbon Dioxide), SS (Electrical Equipment Manufacture or Refurbishment), and UU (Injection of Carbon Dioxide) of Part 98 would or would not be entitled to confidential treatment under the Clean Air Act (CAA). These data elements will be reported to EPA for the first time in 2012. This proposed rule also contains proposed confidentiality determinations for seven new data elements recently added to subparts II (Industrial Wastewater Treatment)and TT (Industrial Waste Landfills), as well as minor updates to Table A-6 of Part 98 to reflect the technical revisions recently made to subpart TT. Reminder: Less Than 14 Days Remaining to Submit Electronic Notices of Intent (NOI's) for Subpart W
Please be aware that there are less than 14 days remaining to electronically submit an NOI to EPA to request the use of best available monitoring methods (BAMM) for 2012. The NOI's must be submitted to EPA electronically through the e-GGRT system by January 3, 2012 for Subpart W for the purposes of fulfilling requirements in 40 CFR 98.234(f)(8). Occasionally, user issues may arise that may take days to resolve. To avoid the possibility of missing this deadline, please submit your NOI as soon as possible. Additional Subpart W Guidance Available
As a follow-up to the Subpart W training on how to submit an NOI or BAMM through the electronic Greenhouse Gas Reporting Tool (e-GGRT), EPA has developed two guidance documents to provide assistance with common questions it has received. The first document, "Guidance for Subpart W Reporters on 'Facility Address'", provides guidance on how to enter a facility address when registering in e-GGRT. The second document, "Guidance for Subpart W (Oil and Natural Gas Systems) Reporters Completing Registration within e-GGRT", addresses questions received about the application of the terms "owner" or "operator" for Onshore Producers. |

Greenhouse Gas Reporting Program: Special Rules Governing Certain Information Obtained Under the Clean Air Act: Technical Correction
On November 9, 2011, the U.S. Environmental Protection Agency finalized technical corrections and other clarifying amendments to seven subparts under the Greenhouse Gas Reporting Rule (40 CFR part 98). In this action, EPA amended 40 CFR part 98 to correct technical and editorial errors and to address certain issues identified as a result of working with entities required to report during rule implementation and outreach. In general, these amendments do not change the overall requirements of the rule but improve clarity and ensure consistency across the calculation, monitoring and data reporting requirements. In addition, EPA has provided a one-time extension of the reporting deadline to September 28, 2012 for any entity that reports under the following source categories:
2011 is the first year for data collection for these subparts. As such, EPA is extending the reporting deadline to ensure that there is sufficient time for development and stakeholder testing of the electronic GHG reporting tool for these subparts. EPA Extends A, I, W Revisions Comment Period Until October 24, 2011
EPA is extending the deadline for the public comment period for the proposed rule titled Technical Revisions and Clarifications to Subpart A, Subpart I, and Subpart W (76 FR 56010). The public comment period for this proposed rule was to conclude on Tuesday October 11, 2011. EPA is extending this deadline from October 11, 2011, to October 24, 2011. The notice regarding this change was published in the Federal Register on October 4, 2011. |

Subpart I Flexibility Rule Finalized
September 16, 2011, U.S. Environmental Protection Agency (EPA) Administrator Lisa P. Jackson signed a final rule that, when effective, allows the largest semiconductor manufacturing facilities the option to use an alternate methodology to calculate their greenhouse gas emissions from etch processes during the reporting years of 2011, 2012, and 2013. This amendment allows use of default emission factors instead of using directly measured recipe-specific emission factors. In addition, the final rule extends two of the dates in the Subpart I provisions related to the use of best available monitoring methods (BAMM). The extension provides all electronics manufacturing facilities additional time to use BAMM in 2011 without submitting a request to the Administrator, and additional time to submit a request to use BAMM to estimate emissions beyond 2011. Subpart W BAMM Rule Finalized
On September 16, 2011, Administrator Jackson signed a rule that finalized amendments to the best available monitoring methods (BAMM) provisions in subpart W. With these amendments, owners and operators of facilities covered by subpart W are now permitted to use BAMM for calendar year 2011 without being required to submit a request for approval from the Administrator. In addition, EPA has expanded the types of emission sources that are permitted to use BAMM in 2011 without being required to submit a request for approval from the Administrator. Lastly, these amendments give owners and operators additional time to request to use BAMM beyond 2011. More information. |

Final Rulemaking - Confidentiality Determinations for Data Required under the Mandatory Greenhouse Gas Reporting Rule and Amendments to Special Rules Governing Certain Information Obtained under the Clean Air Act
On May 19, 2011, the U.S. Environmental Protection Agency (EPA) issued final confidentiality determinations for data elements to be reported under 34 subparts of the Greenhouse Gas Reporting Rule. In this action, EPA also amended the regulations that govern the handling procedures for data collected under the Clean Air Act. Administrator Jackson Signs an Extension for Subpart W BAMM
On April 20, 2011, EPA Administrator Lisa P. Jackson signed a final rule that extends the deadlines for submitting best available monitoring method (BAMM) applications to EPA under the provisions outlined in Subpart W: Petroleum and Natural Gas Systems of the Greenhouse Gas Reporting Rule. Subpart W BAMM Extension Announced
EPA is announcing its intention to extend the deadline for requests to use best available monitoring methods (BAMM) for Petroleum and Natural Gas Systems (Subpart W of the Reporting Rule for Greenhouse Gases) during the 2011 calendar year. EPA intends to extend this deadline from April 30, 2011, to July 31, 2011. EPA also intends to extend by 3 months the period during which owners and operators of certain specific sources may automatically use BAMM without having to request approval by the Administrator. EPA intends to use its authority pursuant to section 307(d)(7)(B) of the Clean Air Act to undertake these actions, and will provide more information about these intended actions in the near future. EPA is announcing its intention to extend the reporting deadline for companies reporting 2010 GHG data, with plans for reporting to begin in late summer. The agency will provide more detail on these intended changes in the coming weeks and will ensure that this reporting extension is in effect before the original reporting deadline of March 31, 2011. Public hearing for "Call for Information on Inputs to Emission Equations Under the Mandatory Reporting of Greenhouse Gases Rule" set for February 3, 2011
EPA will hold a public hearing on the "Call for Information on Inputs to Emission Equations Under the Mandatory Reporting on Greenhouse Gases Rule", published in the Federal Register on December 27, 2010, to accommodate the public in providing information and comment. The hearing on the Call for Information (CFI) will be held on February 3, 2011, at EPA's office located at 1310 L Street, NW, Washington, DC from 1:30 to 5:00 pm. Registration for speakers is required. The deadline for comments submitted to the CFI docket (Docket ID No. EPA-HQ-OAR-2010-0964) is March 7, 2011. Upcoming Deadline for Registration for GHG Reporting
The deadline for reporting of greenhouse gas (GHG) data for facilities and suppliers covered by 40 CFR Part 98 for the 2010 calendar year is rapidly approaching. The first reports are due by March 31, 2011. In order to submit reports, a facility must first submit a valid Certificate of Representation through EPA's electronic Greenhouse Gas Reporting Tool (e-GGRT).
